1. Definitions

In these Terms and Conditions, the following definitions apply:

(a) "The Shop" refers to Glide & Slide, its employees, agents, and authorised representatives.

(b) "The Customer" refers to the individual requesting binding setup, adjustment, mounting, or related services.

(c) "Equipment" refers to the Customer's skis, bindings, boots, and any associated hardware presented for service.

(d) "DIN Setting" refers to the release value at which the binding is set, calculated in accordance with ISO 11088 and the current edition of the relevant binding manufacturer's release-setting charts.

(e) "Services" refers to any binding mounting, adjustment, testing, inspection, or related work carried out by the Shop.

2. Scope of Services

2.1 The Shop offers the following binding-related services: new binding mounting, binding adjustment and DIN setting, binding inspection and function testing, boot-binding compatibility checks, forward pressure adjustment, and anti-friction device inspection.

2.2 All Services are carried out by trained and certified technicians in accordance with manufacturer guidelines and applicable ISO standards (including ISO 11088 and ISO 13993).

2.3 The Shop reserves the right to refuse to carry out any Service where, in the technician's professional judgement, the Equipment is unsafe, incompatible, excessively worn, or otherwise unsuitable for use.

3. Customer Responsibilities

3.1 The Customer must provide accurate and truthful information when completing the binding setup form, including but not limited to: body weight (in ski clothing), height, age, boot sole length, and skiing ability/type.

3.2 The Customer is responsible for ensuring that their boots and skis are presented for service in a clean and serviceable condition.

3.3 The Customer must inform the Shop of any medical conditions, physical limitations, or other factors that may affect the appropriate DIN setting or binding configuration.

3.4 The Customer acknowledges that providing inaccurate or incomplete information may result in incorrect binding settings, which could lead to injury.

4. DIN/Release Value Settings

4.1 DIN settings are calculated using industry-standard charts (ISO 11088) based on the information provided by the Customer. The Shop does not guarantee that the DIN setting will prevent injury in all circumstances.

4.2 If the Customer requests a DIN setting outside the range recommended by the ISO 11088 chart or the binding manufacturer's specifications, the Shop reserves the right to refuse the request. If the Shop agrees to set a non-standard DIN value at the Customer's insistence, the Customer must sign a separate written acknowledgement of the additional risk.

4.3 Release bindings are mechanical safety devices designed to reduce the risk of certain injuries. They cannot eliminate the risk of injury entirely. The Customer acknowledges that no binding can guarantee protection against all types of skiing injuries.

5. Boot-Binding Compatibility

5.1 The Shop will verify that the Customer's boot sole type (e.g., ISO 5355 Alpine, ISO 9523 Touring, GripWalk, WTR) is compatible with the binding system presented for service.

5.2 If the boot and binding are not compatible, the Shop will advise the Customer accordingly and will not proceed with the service until a compatible combination is provided.

5.3 The Customer acknowledges that using incompatible boot and binding combinations may impair the release function of the binding and significantly increase the risk of injury.

6. Equipment Condition & Rejection

6.1 The Shop reserves the right to refuse service on any Equipment that, in the technician's judgement, is unfit for purpose. This includes but is not limited to: bindings with visible damage, corrosion, or excessive wear; bindings that are outside the manufacturer's recommended service life; ski bases or top sheets that are delaminated or structurally compromised; boots with excessively worn sole units or damaged toe/heel lugs.

6.2 Where Equipment is rejected, the Shop will explain the reason for the rejection and may recommend replacement or professional repair.

6.3 The Shop accepts no liability for any loss, damage, or inconvenience arising from the refusal to service unsuitable Equipment.

7. Mounting

7.1 Bindings will be mounted at the manufacturer's recommended mounting position unless the Customer specifies an alternative position in writing.

7.2 The Customer acknowledges that once holes are drilled in the ski for binding mounting, the ski is permanently altered. The Shop is not liable for any reduction in resale value or aesthetic changes resulting from properly executed mounting.

7.3 Re-mounting bindings on previously drilled skis may be possible at the Shop's discretion. The Shop will advise whether re-mounting is feasible and safe. Additional charges may apply.

8. Testing & Inspection

8.1 Following adjustment or mounting, all bindings are function-tested using calibrated equipment. The Shop will record the measured release values and provide these to the Customer upon request.

8.2 The Shop recommends that bindings be professionally inspected and tested at least once per season, or whenever the Customer's weight, ability, boot, or physical condition changes.

8.3 Calibration of testing equipment is maintained in accordance with manufacturer and industry requirements.

9. Assumption of Risk

9.1 The Customer acknowledges that skiing and snowboarding are inherently dangerous activities that carry a risk of serious injury or death, regardless of the condition or settings of their Equipment.

9.2 The Customer acknowledges that release bindings are designed to reduce, but cannot eliminate, the risk of lower-leg and knee injuries. Pre-release (unintended release) and non-release (failure to release) may occur even with correctly set bindings.

9.3 The Customer accepts all risks associated with the use of their Equipment, including risks arising from changing snow conditions, terrain, weather, collisions, and the Customer's own skiing behaviour.

10. Limitation of Liability

10.1 The Shop shall not be liable for any injury, loss, or damage arising from the use of Equipment except where such injury, loss, or damage is caused directly by the Shop's negligence or breach of statutory duty.

10.2 Nothing in these Terms and Conditions excludes or limits the Shop's liability for death or personal injury caused by the Shop's negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

10.3 The Shop's total aggregate liability under or in connection with these Terms and Conditions shall not exceed the total fees paid by the Customer for the Services in question.

10.4 The Shop shall not be liable for any indirect, consequential, or special losses, including but not limited to loss of enjoyment, lost holiday costs, or loss of earnings.

11. Warranty & Recalls

11.1 The Shop warrants that all Services have been performed with reasonable skill and care in accordance with industry standards. This warranty applies for a period of 12 months from the date of service or until the Equipment is adjusted by a third party, whichever occurs first.

11.2 The Shop does not provide any warranty in respect of the Equipment itself. Any manufacturer's warranty on the Equipment remains with the manufacturer and is subject to the manufacturer's own terms and conditions.

11.3 In the event of a manufacturer safety recall or notice affecting the Customer's bindings, the Shop will use reasonable endeavours to notify the Customer, but accepts no liability for failure to do so.

12. Self-Adjustment Disclaimer

12.1 The Shop strongly advises against any self-adjustment of binding settings by the Customer or any unqualified third party.

12.2 Any adjustment to the Equipment made after the Shop has completed its Services, whether by the Customer or a third party, voids the Shop's warranty and releases the Shop from any liability in respect of subsequent binding performance.

12.3 The Customer is advised to return to the Shop or another qualified service provider if any adjustment is required.

13. Data Protection & Records

13.1 The Shop will collect and retain the Customer's personal data (including name, contact details, physical measurements, and Equipment details) for the purpose of providing and recording the Services. Data will be processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

13.2 Service records, including DIN settings and Equipment details, will be retained for a minimum of 3 years for safety and liability purposes.

13.3 The Customer may request access to, correction of, or deletion of their personal data by contacting the Shop in writing.

14. Pricing, Payment & Collection

14.1 The Shop will provide a quotation for all Services before work commences. Any additional work required will be communicated to the Customer and agreed before it is undertaken.

14.2 Payment is due in full upon collection of Equipment.

14.3 Equipment not collected within 30 days of notification that Services are complete may be subject to a storage charge. Equipment not collected within 90 days may be disposed of at the Shop's discretion.

15. Governing Law & Disputes

15.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

15.2 Any dispute arising under or in connection with these Terms and Conditions shall first be addressed through informal negotiation. If unresolved within 30 days, the parties may refer the matter to mediation or to the courts of England and Wales.

15.3 Nothing in these Terms and Conditions affects the Customer's statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
